TERMS AND CONDITIONS

The Fan Fest Society is a division of Wild Berry & Whimsy Productions LLC (hereinafter collectively “The Fan Fest Society”). The following terms and conditions apply to all The Fan Fest Society activities and events, including in-person and virtual events, contact form submissions and social media participation (the “Terms and Conditions”). By purchasing any tickets or by attending any activities or events of The Fan Fest Society, you are entering into a legally binding contract comprised of these Terms and Conditions, and you explicitly agree to comply with and be bound by these Terms and Conditions, including any and all terms, policies, guidelines, laws, and regulations incorporated by reference herein. 

You represent and warrant to The Fan Fest Society that you have full authority to complete this registration on your behalf and/or any other party you register, including full authority to make use of the credit card or debit card to which registration fees will be charged.

Changes to Terms. The Fan Fest Society reserves the right to make changes to the Terms and Conditions at any time. Such revisions will be effective as of the date posted on The Fan Fest Society’s website at www.thefanfestsociety.com.

Refusal or Cancellation of Purchases. The Fan Fest Society reserves the right, without refund of any amount paid, in its sole discretion and at any time, to cancel or refuse any individual or company the following: credentials, applications, purchases and tickets. The Fan Fest Society will not be responsible for any penalty, fee, loss, or expense that might result from such action.

ALL SALES ARE FINAL All events are rain or shine, unless otherwise noted. All programming, cast appearances, times, and locations are subject to change without notice. No single event is guaranteed. The capacity of each individual festival event, attraction, screening or panel is limited by the venue size. 

NO REFUNDS. Payments are not refundable for any reason.

No refunds will be issued due to a cast member or activity being removed from the festival lineup, and no refunds will be issued due to unavailability due to capacity of a specific attraction.

No refunds will be provided for credentials, badges and/or wristbands that have been revoked.

No refunds will be provided for your failure to use The Fan Fest Society credentials due to actions by you, by The Fan Fest Society, or any beyond your or The Fan Fest Society’s reasonable control, including without limitation, duplicate purchases, illness (including without limitation COVID-19 and any resulting closures or quarantines), travel-related problems, loss of employment, acts of God, labor disputes or other industrial disturbances, electrical or power outages, utilities or other telecommunication failures, earthquakes, storms, or other elements of nature, blockages, embargoes, riots, pandemics (and business or government closures, restrictions, or quarantines relating to same),  venue unavailability, acts or orders of government, and acts of terrorism, or war.

No refunds will be given if an event is postponed or rescheduled. If an event is postponed or rescheduled (even if there is no new date set for the event yet), you understand that your order will not qualify for a refund, credit, or return, and that your tickets will only be valid for the respective rescheduled date.

In the event that refunds are offered, the decision as to whether you are entitled to a refund is determined by The Fan Fest Society, in its sole discretion, and must be considered final. If refunds are offered, you must adhere to The Fan Fest Society’s instructions and deadlines concerning such refunds.

COVID-19

COVID-10 Warning. Although The Fan Fest Society has established policies aimed at reducing risk and safeguarding your health, an inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is a contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting COVID-19 or any other communicable disease or illness, or a bacteria, virus or other pathogen capable of causing a communicable disease or illness, whether occurring before, during, or after the event, however caused or contracted, and voluntarily waive all claims and potential claims against The Fan Fest Society, and its affiliated companies relating to such risks.

Updated COVID-19 Policy August 8, 2022

As of 8/8/22, Ogunquit does not have mandates in place to protect visitors from COVID-19 & it’s variants. Visitors are encouraged to use their best judgement entering establishments. The Fan Fest will hold that stance for now too, asking that all attendees do their part to stop community spread of COVID-19 and other illnesses. Our sincere hope is that 100% of our attendees are vaccinated.

Ticket holders must agree to be flexible in the event that the policy changes closer to the event.

As of 8/8/22, we do not plan on enforcing a vaccination policy & masks will not be required, simply encouraged. We reserve the right to adjust this stance, back to our previous vaccine mandate & indoor mask requirement, based on what’s happening locally—and across the country, or in our sole determination, if necessary. (For more information, see original policy outlined below).

To reiterate, while we do not plan on checking vaccine cards this year, this could change based on city & state rules before 9/29/22. Regardless of all policy changes, refunds will not be given at any time.

Vaccinations - Not mandatory as of 8/7. (*if required at the time of the event, a negative PCR test taken within 48 hours can replace a vaccination card)

Masks - Not mandatory as of 8/7, but may be necessary indoors by 9/29/22.

*By purchasing tickets you agree to any policy changes, at any time before the event

As always, masks are welcome and vaccines are encouraged.

Original COVID-19 Policy Prior to 8/8/22. All attendees, regardless of age, are required to show proof of full, current COVID vaccination. A negative test result (on site) may be allowed upon entry, each day, into a festival or event (other than an online, virtual event) with previous written permission from The Fan Fest Society, for confirmed medical exceptions only. Please check the event page, one month prior to event, on The Fan Fest Society’s website for any updated details on the policy, which will include accepted forms of documentation, accepted tests and timelines, and any age restrictions for the event.

Also, as of the time of the posting of these Terms & Conditions, face masks are required for entry into The Fan Fest Society’s festivals and events. Masks must completely cover nose and mouth. Masks must be worn at all times indoors.

Agreement to The Fan Fest Society’s COVID-19 Policies. Because of public health safeguards required by COVID-19, your tickets and admission to events you purchase are subject to the health and safety policies set by The Fan Fest Society. You hereby agree that The Fan Fest Society may continually update and develop their policies between the time of your ticket purchase and the date of the event. By using the credentials you purchased you hereby agree that you will abide by these policies, and your ability to attend the purchased event is conditioned on this compliance with policies. If you are denied admission to the event by The Fan Fest Society, or your admission is revoked by The Fan Fest Society, as a result of any safety and health policies, including relating to COVID tests or vaccines, you will be ineligible for compensation or a refund.


Purchases and Credentials

Attendee names must be added to each order at the time of purchase. For orders over a quantity of one, all names must be added at the time of purchase.  There is a $50 administrative processing fee to change a ticket holder name on any credential, and ALL changes must be submitted by two weeks before any in-person or virtual event.

The Fan Fest Society credentials are issued to authorized individuals and can be picked up and used only by the authorized individual named. The Fan Fest Society credentials are non-transferable after they have been picked up. All badges, wristbands, and tickets are property of The Fan Fest Society. The Fan Fest Society reserves the right to revoke credentials for misuse (for example, if anyone other than the authorized individual tries to use a badge, wristband or ticket).

Badges give priority entry, but cannot guarantee admission to any event. Admission is subject to venue capacity and age restrictions in compliance with state and local laws. Age restrictions are specific to each venue.

Lost or stolen badges, wristbands, or tickets will not be replaced. New credentials will need to be purchased for continued access to all events.

No one under the age of 4 is permitted to attend any of the events dedicated to ticket holders. Anyone over the age of 4 must have their own ticket to attend an event.

Tickets to The Fan Fest Society events may not be used as a prize in any form of contest, game, or sweepstakes without written pre-approval from The Fan Fest Society.

Intellectual Property Rights. THE FAN FEST SOCIETY name and logo are  the sole property of Wild Berry & Whimsy Productions LLC. Any other trademark, trade names, logos, character or fictional place names, are the property of their respective owners.  The Fan Fest Society festival, events, gatherings, materials, and merchandise are owned by Wild Berry & Whimsy Productions LLC or its licensors.  Nothing should be construed as granting to you, by implication or otherwise, any license or right to participate in or associate with the event without the express written consent of Wild Berry & Whimsy Productions LLC in each instance. Your participation or attendance at any event does not convey to you any rights in any of the intellectual property associated with the event or of Wild Berry & Whimsy Productions LLC or its licensors.

***PHOTO/IMAGE RELEASE***If you attend an event or are out in public places near our event, you will likely be captured on camera. Photographs and/or video taken at our events by The Fan Fest Society, or others on behalf of The Fan Fest Society, may include your image, voice and/or likeness. By attending or participating in The Fan Fest Society events, you hereby give The Fan Fest Society permission to use your photograph, image, likeness, voice and statements for any purpose, in any medium now known or hereinafter developed, without further consent or authorization from or notification to you. without compensation or credit to you.

Appropriate Behavior. Registrants and attendees of The Fan Fest Society events are expected to behave responsibly and to treat each other – and treat the community – with respect, kindness, and compassion. The Fan Fest Society reserves the right, without refund, to revoke the credentials of registrants whose conduct is deemed inappropriate, disorderly, offensive, or in violation of the terms and conditions and any other festival policies, by The Fan Fest Society or the local authorities. 

Sole Host and Producer. As a reminder, The Fan Fest Society festivals are produced and hosted by Wild Berry & Whimsy, who has contracted with the appropriate authorities and locations for permission to do so, and as the host, it has sole control over the production and content of the festivals and events, including things like locations, PR, marketing, advertising, and merchandising services. The Fan Fest Society will select the vendors and sponsors, if any, and the talent, and other service providers for the festivals and events. During your attendance at any The Fan Fest Society events, you agree you will not put on or host any gathering or activity related to the subject matter of The Fan Fest Society events, and will not hold yourself out as authorized by or affiliated with The Fan Fest Society, unless you are working with and are part of an official The Fan Fest Society event, and/or have express written permission from The Fan Fest Society to do so. 

Assumption of Risk. You understand that participating in The Fan Fest Society is voluntary and may involve certain risks of physical injury, damage to property, and other damages are losses that you may sustain. You assume all risk of damages, property loss, and personal injury which may occur by participating in The Fan Fest Society.

Disclaimer. In no event shall The Fan Fest Society be liable to you or any other person or entity for any injury or damages to property, damages for loss of business profits or other pecuniary loss, including any direct, consequential, incidental, special, punitive or similar damages, arising out of your use of the registration and/or participation in The Fan Fest Society, even if The Fan Fest Society has been advised of the possibility of such damages. 

Indemnity. You agree to indemnify and hold The Fan Fest Society and its affiliated companies, and their respective officers, employees, volunteers, and representatives harmless from and against any and all claims, demands and all other liabilities, including, but not limited to, costs and attorneys’ fees, made by any third party arising out of or in connection with your purchase of credentials and/or attendance at any The Fan Fest Society festival or event, or violation of these Terms and Conditions.

Miscellaneous.

Lost and Found will be located at the merch booth during any live event. 

The Terms and Conditions will be governed by the laws of the State of Texas without regard to its principles of conflicts of laws. You hereby irrevocably submit to the exclusive jurisdiction of the United States federal and state courts located in Texas (Western District) and agree that any such court will be the proper forum for the determination of any dispute arising hereunder.

The Fan Fest Society reserves the right to make changes to the Terms and Conditions at any time. In the event that any term or provision of the Terms and Conditions shall be deemed invalid, illegal or unenforceable in any respect, such term or provision shall be deemed severable and shall not affect the validity and enforceability of any remaining term or provision.

ACCESSIBILITY INFORMATION

The Fan Fest Society works hard to make sure that all our events are accessible to all attendees.

All official venues where seating is provided will have ADA accessible seating for attendees who require said seating because of a mobility disability. A companion will also be able to utilize the ADA seating. Seating for attendees with a mobility disability and one companion is on a first-come first-served basis, and once an event starts, all unclaimed accessible seating will be made available to general admission. If you would like to utilize the ADA seating, please alert a volunteer when you arrive at an event.

Trained service animals of attendees with disabilities are welcome at all events, in compliance with venue policies.

ADMISSION POLICY

All seating at The Fan Fest Society is first-come, first-served (no assigned seats), unless otherwise noted. Admission for each activity is only to venue capacity. 

PRIVACY POLICY

The Fan Fest Society recognizes that your privacy is very important. We know that providing personal information is an act of trust and we take that seriously.

When submitting your email address to us, know that your email address will not be taken from our site and added to bulk mailing lists. The only people who will have access to your personal information are The Fan Fest Society staff and you the subscriber.

Each time you visit http://www.thefanfestsociety.com, we collect some information automatically about your computer by means of a "cookie". A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. Generally, we use cookies to look at trends of behavior on our website and to help target advertisements based on your interests and behavior. This cookie tracking was implemented January 1, 2021.

VENDOR SALES / SOLICITATION POLICY

The sale of merchandise and/or services at venues to individuals by entities other than The Fan Fest Society or its partners/sponsors (including but not limited to for-profit individuals, for-profit organizations or not-for-profit organizations or individuals representing not-for-profit organizations) is prohibited except under the following condition:

Outside Vendors who have submitted a Vendor Agreement Form to participate in a specific The Fan Fest Society event that allows outside vendors, and have been approved by The Fan Fest Society. The Fan Fest Society reserves the right to revoke approval for any reason, at any time.

WEAPONS POLICY

The Fan Fest Society has a strict Weapons-Free Policy.

The Fan Fest Society is a private event and attendees are prohibited from carrying weapons of any kind. Prohibited items include but are not limited to guns, ammunition, tasers, knives, sharp objects or explosives of any kind, whether carried openly or concealed, and are still prohibited even if the weapons are inoperable or unusable. Items that may be legal for you to own or carry are not welcome at our events if they violate this weapons policy.

Your participation at The Fan Fest Society events means that you agree to comply with this weapons policy, regardless of whether the weapons policy is posted at the premises of any official event.

You further understand and agree that, for your own safety and the safety of everyone at the festival, we have the absolute and immediate right to inspect your bags, coats, and any other item you bring to the festival. Your safety, and everyone else's, is very important to us.
